Terms & Conditions

Introduction

Welcome to Legacy Fitness and Athletics (“the Facility”). These Terms and Conditions (“Terms”) govern your use of our website, services, and membership at Legacy Fitness and Athletics. By accessing or using our services, you agree to be bound by these Terms. Please read them carefully before using our services.

  1. Membership Terms

1.1 Refund Policy:
All payments made under any membership contract are non-refundable.

1.2 Cancellation by Gym:
The Facility reserves the right to cancel your membership contract at any time for any reason, including but not limited to, failure by the Member to comply with the Facility’s policies and rules. In the event of such cancellation, any prepaid Membership Fees will be refunded on a prorated basis.

1.3 Cancellation by Member:
Members may cancel their membership contract by providing written notice to the Facility at least thirty (30) days before the desired cancellation date. For month-to-month 1-Year Commitment Memberships, a cancellation fee equal to 50% of the remaining membership fees will be charged upon early termination. This does not apply to memberships paid in full.

  1. Waiver and Release of Liability

2.1 Acknowledgment of Risk:
Members acknowledge that the use of the Facility’s services, including but not limited to gym equipment, group classes, sauna, and personal training, carries inherent risks of injury, illness, or death. By using the Facility and its services, Members voluntarily assume all risks associated with such use.

2.2 Release of Liability:
Members agree to release, discharge, and hold harmless Legacy Fitness and Athletics, its owners, employees, agents, and representatives from any and all claims, liabilities, damages, or expenses that may arise from their use of the Facility or participation in its services, due to any cause whatsoever, including without limitation the negligence of the Facility, breach of contract, or breach of any statutory duty or other duty of care owing under occupiers’ liability legislation or otherwise.

2.3 Waiver of Claims:
Members expressly waive and release any and all claims and covenant not to make or bring any such claim against the Facility. This waiver applies to any and all claims for injury or damage, whether known or unknown, arising out of the use of the Facility.

  1. Personal Development Contract Terms

3.1 Cancellation Policy – Member Rights Under The Consumer Protection and Business Practices Act:
Members may cancel their contract without any penalty or obligation within seven (7) business days after receiving a signed copy of the contract. Cancellation must be done in writing and sent to the Facility’s business address, either by registered mail or by personal service. The Member is not required to provide the Facility with a reason for cancellation during this period.

There may be other grounds that allow Members to cancel their contract. For more information, Members may contact the Consumer Protection Division, Financial and Consumer Affairs Authority of Saskatchewan. If the Member cancels the contract under this section, the Facility has fifteen (15) days to refund any payments made under the contract.

3.2 Renewal:
This contract does not automatically renew. Upon completion of the selected membership term, Members must sign a new contract to continue using the Facility’s services.

3.3 Changes to Terms:
The Facility reserves the right to make reasonable changes to the services and fees at any time, provided that Members are given 30 days’ notice.

3.4 Lock-in Period:
Members who purchase a 12-month term membership are locked in for the entire term of their contract, except in the following situations:

  1. Relocation: If the Member moves more than 30 km away from the current gym location, they may cancel the membership by providing proof of the new address.
  2. Gym Relocation: If the Gym relocates more than 10 km away from its current location, the Member may cancel the membership.
  3. Health Issues: If the Member experiences prolonged ailments that result in their inability to participate in physical activity, they may cancel the membership by providing a medical certificate.
  4. Signature and Agreement

By signing the membership contract or agreeing to these Terms online, the Member agrees to all terms and conditions outlined in this document, including the waiver and release of liability. The Member also confirms that they have read and understood the FCAA personal development contract terms.
